Terms of Service

Welcome to CupidMsg. These Terms of Service (“Terms”) govern your access to and use of the CupidMsg mobile application, website, and related services (collectively, the “Service”), operated by CupidMsg, Inc. (“CupidMsg,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use CupidMsg. By using the Service, you represent and warrant that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding agreement.
  • You are not prohibited from using the Service under any applicable law.
  • You have not been previously banned or removed from the Service.
  • You do not have any unresolved felony convictions or sex-offense registrations.

2. Account Registration

To use CupidMsg, you must create an account using a valid email address or Google account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are solely responsible for all activity under your account. Notify us immediately at support@cupidmsg.com if you suspect unauthorized access.

3. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Harass, threaten, stalk, intimidate, or abuse any other user.
  • Post or transmit content that is defamatory, obscene, pornographic, violent, hateful, or discriminatory.
  • Impersonate any person or entity, or misrepresent your identity, age, or affiliation.
  • Use the Service to solicit money, promote commercial products, or engage in spam.
  • Upload viruses, malware, or any harmful code.
  • Attempt to gain unauthorized access to other users' accounts, our systems, or data.
  • Use automated scripts, bots, scrapers, or other automated means to access the Service.
  • Circumvent, disable, or interfere with security features of the Service.
  • Create multiple accounts for deceptive or abusive purposes.
  • Share, sell, or transfer your account to another person.

4. User Content

You retain ownership of content you submit (“User Content”), including photos, text, and profile information. By posting User Content, you grant CupidMsg a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content solely in connection with operating and improving the Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content.
  • Your User Content does not infringe any third party's intellectual property or privacy rights.
  • Your User Content complies with these Terms and all applicable laws.

We reserve the right to remove any User Content that violates these Terms, without notice. We are not responsible for User Content posted by other users.

5. Premium Subscriptions

CupidMsg offers optional paid subscription plans (“Premium”) with additional features. By subscribing:

  • You authorize us to charge your payment method on a recurring basis (monthly or annually) until cancelled.
  • Subscription fees are non-refundable except as required by applicable law or as stated in our refund policy.
  • You may cancel your subscription at any time through the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change subscription pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
  • We offer a 7-day satisfaction guarantee for new subscribers. Contact support@cupidmsg.com within 7 days of your first payment for a full refund.

6. Safety & Interactions

CupidMsg is not responsible for the conduct of any user, whether online or offline. You acknowledge that:

  • We do not conduct criminal background checks on users.
  • We do not verify the accuracy of user-provided information beyond email verification.
  • You are solely responsible for your interactions with other users.
  • You should exercise caution and good judgment when communicating with or meeting other users.
  • You should never send money to other users or share sensitive financial information.

Meeting in person: If you choose to meet someone in person, always meet in a public place, tell a friend or family member your plans, and arrange your own transportation. CupidMsg is not liable for any harm arising from in-person meetings.

7. Reporting & Blocking

You may report or block any user who violates these Terms or makes you feel unsafe. We review all reports and may take action including warnings, temporary suspensions, or permanent bans at our sole discretion. We are not obligated to disclose the outcome of any investigation.

8. Intellectual Property

The Service, including its design, logos, trademarks, text, graphics, software, and all other content (excluding User Content), is owned by CupidMsg, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE QUALITY, ACCURACY, OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE, INCLUDING USER PROFILES, COMPATIBILITY SCORES, OR MATCH SUGGESTIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUPIDMSG, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

  • Your use of or inability to use the Service.
  • Any conduct or content of any user or third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Any in-person meetings or interactions with other users.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO CUPIDMSG IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless CupidMsg, Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) your User Content.

12. Dispute Resolution & Arbitration

Informal Resolution: Before filing any formal dispute, you agree to contact us at support@cupidmsg.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration:Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may bring claims in small claims court if eligible. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately. Sections 4, 8–13, and 15 survive termination.

15. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and CupidMsg.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver.
  • Assignment: You may not assign these Terms. We may assign our rights and obligations without restriction.
  • Modifications: We may modify these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.
