DMCA & Copyright Policy

CupidMsg, Inc. (“CupidMsg”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to valid notices of alleged copyright infringement that comply with the DMCA and this policy. This policy forms part of our Terms of Service.
1. Reporting Copyright Infringement
If you believe that content on CupidMsg infringes your copyright, you may submit a written notice to our Designated Copyright Agent (see Section 4). Your notice must include substantially the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with enough detail for us to locate it (for example, the profile, username, or a link/description of the specific content).
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages.
2. Our Response
Upon receiving a valid notice, we will expeditiously remove or disable access to the allegedly infringing material and take reasonable steps to notify the user who posted it. We may also, in appropriate circumstances and at our discretion, remove content we believe in good faith may be infringing.
3. Counter-Notification
If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent that includes substantially the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which it appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., in any judicial district in which CupidMsg may be found), and that you will accept service of process from the person who submitted the original notice or their agent.
If we receive a valid counter-notification, we may restore the removed material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5. Repeat Infringer Policy
CupidMsg will, in appropriate circumstances, disable and/or terminate the accounts of users who are determined to be repeat infringers, in accordance with the DMCA.
